United States Senator Ted Cruz gave a bizarre interpretation of the 1st and 4th amendments. He claimed that government has created no exceptions to our right to free speech and our right to not be searched. On this basis he declared his opposition to the assault weapons ban because he believes government should make no exceptions to the 2nd amendment; just like the 1st and 4th.
As everyone knows, of course, there are plenty of exceptions on the 1st and 4th amendments. We can’t publish government secrets, or yell fire in a theater, or possess child pornography. Likewise, the police can give you a warrantless breathalyzer and the President can unilaterally declare you an “Enemy Combatant” and instantly hold you without charge, without attorney, and without a speedy trial.
Why do these exceptions exist? To protect the public, and the Supreme Court has ruled them all constitutional. Similarly, the exceptions being considered to the 2nd amendment, have been ruled constitutional and are designed to protect the public.
